Effective date: July 4, 2026. These Terms of Service are the rules for using the Humour Closet website (humourcloset.com) and related services, and they cover who may use the site, what you may and may not do, our rights and yours, and how disputes are handled.
These Terms of Service (the "Terms") form a legal agreement between you and Humour Closet Media, Inc. ("Humour Closet," "we," "us," or "our"). Please read them carefully. They include an agreement to resolve disputes by binding arbitration and a waiver of class actions (see "Governing Law and Arbitration" below).
1. Acceptance of These Terms
By accessing or using humourcloset.com (the "Site"), our YouTube channel, or any feature we offer (together, the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
Certain activities are governed by additional documents that become part of this agreement when they apply to you:
- Submitting a video is also governed by our Terms of Submission.
- Entering our contest is also governed by our Contest Rules.
- Copyright and takedown matters are handled under our Copyright / DMCA Policy.
If any of those documents conflict with these Terms on a topic they specifically cover, that more specific document controls for that topic.
2. Eligibility and Age
You must be at least 13 years old to use the Service. By using the Service, you confirm that you are 13 or older and that you are able to enter into this agreement. If you are under the age of majority where you live, you must have your parent or guardian's permission to use the Service. You do not need to create an account to browse the Site or to submit a video. Some features have extra requirements — for example, contest entry is limited to eligible US residents as described in the Contest Rules.
3. What the Service Is
Humour Closet is a website that curates funny fails, bloopers, and viral clips, and runs a related YouTube channel (@HumorCloset). The Service includes:
- Browsing curated funny videos and content we publish or feature;
- Viewing our public YouTube videos, which we display on the Site through the YouTube Data API (a Google service);
- Submitting your own original video through the submission form, subject to the Terms of Submission; and
- Entering our quarterly contest for a chance to win a cash prize, subject to the Contest Rules.
We may add, change, or remove parts of the Service at any time.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in a way that respects others. When you use the Service, you must not:
- Use the Service for any unlawful purpose, or in violation of any applicable law or regulation;
- Submit, post, or transmit content that is infringing, defamatory, harassing, hateful, obscene, or that violates the privacy or intellectual-property rights of any person;
- Upload or submit content you did not create yourself or do not have the right to submit (see the Terms of Submission for the rights and warranties that apply to submissions);
- Upload viruses, malware, or any code designed to harm, disrupt, or gain unauthorized access to the Service, our systems, or other users;
- Attempt to gain unauthorized access to any part of the Service, our servers, or the storage and processing systems that support it;
- Use bots, scrapers, or other automated means to access the Service, or engage in bulk, automated, or abusive use of the upload or submission system (for example, mass or repeated submissions intended to overload or exploit it);
- Interfere with or disrupt the Service or the networks and infrastructure connected to it; or
- Impersonate any person or misrepresent your identity or your connection to any person.
We may investigate suspected violations and may block access, remove content, or take other appropriate action. Because we do not require accounts, this generally means blocking access or removing content rather than closing an account.
5. Video Submissions and the Contest
These Terms govern general use of the Site. Two activities have their own, additional rules:
- Video submissions. If you submit a video (by uploading a file or pasting a link), the Terms of Submission also apply. This includes the confirmations you make at submission — that you personally recorded the video and are its sole creator, that you are 13 or older, and that you agree to these Terms and the Terms of Submission — and the license you grant in your content. That license is broad: by submitting, you grant Humour Closet an exclusive, unlimited, perpetual, worldwide license to use, edit, reproduce, distribute, broadcast, license, advertise, and otherwise exploit your content in any and all media, and you promise that you are the sole owner of all rights in it and that it infringes no one else's rights. Read the Terms of Submission in full before you submit.
- The contest. Our quarterly contest is a separate promotion governed by the Contest Rules, which set out eligibility, how winners are chosen and paid, tax responsibilities, and the rights you grant by entering. No purchase is necessary to enter.
You can find out how we handle the personal information you provide (such as your name and email) in our Privacy Policy. To ask us to access or delete your information, or to withdraw a video you submitted, email privacy@humourcloset.com.
6. Intellectual Property in the Site
The Service itself — including the "Humour Closet" name, logo, branding, design, layout, text, graphics, and the selection and arrangement of the content we publish — is owned by Humour Closet Media, Inc. or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable permission to access and use the Service for your own personal, non-commercial use.
You may not copy, reproduce, republish, distribute, modify, or create derivative works from the Site or our branding without our prior written permission, except where the law expressly allows it. This section does not affect the rights in content you submit — those are addressed in the Terms of Submission and, for contest entries, the Contest Rules.
7. Third-Party Links and Services
The Service relies on and links to third-party services that we do not control. For example, we display our videos through YouTube (a Google service), load web fonts from Google Fonts, and accept video links from platforms such as YouTube, TikTok, Instagram, Facebook, Google Drive, and Dropbox. Embedded YouTube and other Google services may set their own cookies. How we use these services is described in our Privacy Policy.
We are not responsible for the content, policies, or practices of any third-party site or service, and providing a link or embed is not an endorsement. When you interact with a third-party service, that service's own terms and privacy policy apply to you.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that any content on the Service is accurate, complete, or current. You use the Service at your own risk. We take reasonable steps to operate the Service, but we cannot and do not guarantee any specific level of security. 9. Limitation of Liability
To the fullest extent permitted by law, Humour Closet Media, Inc. and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed one hundred US dollars (US $100.00). Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you; in that case, our liability is limited to the smallest amount permitted by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless Humour Closet Media, Inc. and its officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms or any of the additional documents referenced here; (c) any content you submit; or (d) your violation of any law or the rights of any third party.
11. Governing Law and Arbitration
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules.
Consistent with our Contest Rules, any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally will be settled by binding arbitration administered by JAMS under its applicable rules, rather than in court. The arbitration will be conducted, and any permitted court proceeding will take place, in Los Angeles, California. You and Humour Closet agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class or representative action. To the extent a claim proceeds in court despite this section, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Los Angeles, California.
Nothing in this section prevents either party from seeking to stop actual or threatened infringement, misuse, or unauthorized access through injunctive or other equitable relief where the law allows.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will change the effective date at the top of this page and post the updated version here. Changes take effect when posted. If you continue to use the Service after an update, you accept the revised Terms. We encourage you to review this page periodically.
13. Miscellaneous
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the documents referenced in them, are the entire agreement between you and Humour Closet regarding the Service. You may not transfer your rights under these Terms; we may transfer ours in connection with a merger, acquisition, or sale of assets.
